The Supreme Court today stayed a Calcutta High Court order disqualifying veteran leader Mukul Roy as a West Bengal MLA for defecting from the BJP to the ruling Trinamool Congress.
A bench of Chief Justice Surya Kant and Justice Joymalya Bagchi stayed the high court judgment and issued notice on a petition filed by Roy’s son, Subhranshu Roy, challenging the disqualification. The high court had held that Roy, elected on a BJP ticket from Krishnanagar Uttar in 2021, incurred disqualification under the anti-defection law after joining the TMC and had also set aside his PAC chairmanship.
