Nepal: Supreme Court orders government to submit details of demolition of squatters’ settlement

The Supreme Court of Nepal has directed the federal government to furnish detailed documents related to the procedures followed in demolishing squatters’ settlements. A single bench of Justice Sunil Kumar Pokharel issued the order, seeking clarification on whether mandatory constitutional provisions and processes under the Right to Housing Act, 2075 BS, were duly followed. The Court has also asked the government to provide objective details regarding rehabilitation measures, including arrangements for food supply and healthcare, particularly for senior citizens, patients, and persons with disabilities.


The apex court has sought also information on alternative provisions made for children’s education, as well as the overall status of basic human rights of those displaced. The Office of the Attorney General has been ordered to submit a written response outlining the grounds and reasons for the actions taken within 15 days.
