Delhi HC Issues Notice on ED’s Plea Seeking Expunging of Adverse Observations in Excise Policy Case

The Delhi High Court today issued notice to all respondents, including former Delhi Chief Minister Arvind Kejriwal and former Deputy Chief Minister Manish Sisodia, on a plea filed by the Enforcement Directorate. The court listed the matter for further hearing on March 19 and observed that it would pass an appropriate interim order in the case.

ED has moved the Delhi HC to expunge adverse remarks made by the trial court against the agency while discharging Arvind Kejriwal, Manish Sisodia and all other accused in the excise policy case.

Appearing for the central agency, Additional Solicitor General S. V. Raju submitted that the trial court made the remarks against the ED while deciding a case registered by the Central Bureau of Investigation. He said the money laundering case under the Prevention of Money Laundering Act was not before the Special Court when the observations were made. The High Court said it would examine whether such remarks could have been made and will hear the matter further after responses are filed.
